Scholl's Wellness Co. ("Scholls" or "we" or "us" or "our") is an American footwear and orthopedic foot care company founded in 1906 by Dr. William Mathias Scholl under the brand name, Dr. Scholl's RR. Scholls maintains the website "drscholls.com", all associated sub-domains, stand-alone and/or self-serve sites for kiosks and apps (collectively "the Sites"). The purpose of the Sites is to provide Scholl's visitors and customers ("customer(s)" or "user(s)" or "you" or "your") with electronic access related to its offerings.

Scholls reserves the right, in its sole discretion and without any obligation, to change the terms of this Privacy Policy at any time. You are responsible for regularly reviewing this Privacy Policy for any such changes. Continued use of the Sites, including after any such changes have been posted, shall constitute your agreement to such changes.

As used in this Privacy Policy, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular person. 

PERSONAL INFORMATION WE COLLECT

We collect the following categories of personal information:

·        Identifiers. We collect your first and last name, email address, phone number, postal address, usernames, passwords, IP address, and unique cookie and device identifiers in connection with your use of our Site and related services. For example, when you place an order, sign up for our email marketing programs, submit a product review, contact us through a form, use our Custom Fit Kiosk, or participate in our Insole Advisor tool, we collect identifiers necessary to provide those services.

·        Commercial Information. We collect records of your orders, including order details, products purchased, order value, coupon or promotion usage, and merchandising totals. We also collect newsletter and communication preferences.

·        Internet or Other Electronic Network Activity Information. We collect information about your browsing history on our Site, including pages visited, search history, network information, device and browser type, version and settings, and other behavioral interactions with our content, such as product pages viewed, blog posts read, completion of the Insole Advisor, use of the Kiosk Locator, clicks on the "Where To Buy" button, add-to-cart events, checkout initiations and completions, purchases, and CTA button clicks. This information is collected through tracking pixels, tags, and cookies placed on the Site by us and our advertising and analytics partners.

·        Geolocation Data. We collect your IP address to determine your approximate geographic location. We use geolocation data to provide you with information about the nearest Custom Fit Orthotics Kiosk and to indicate where our products can be purchased nearest to your location.

·        Inferences. Our advertising partners may draw inferences from the information described above to create a profile reflecting your preferences, characteristics, behaviors, and attitudes for the purpose of delivering targeted advertising.

·        Sensory Data. If you use our Custom Fit Kiosk, we may collect information related to your foot assessment, including lifestyle questions, product usage intent, and shoe size, in order to recommend a custom-fit orthotic insole.

·        Aggregate dataWe deidentify and/or aggregate the data we collect and use and share it, in deidentified and/or aggregated form, for benchmarking purposes, advertising, and internal analytics. We maintain and use this data in deidentified form. We will not attempt to reidentify the data unless it is necessary to determine whether our deidentification processes satisfy applicable data protection laws.

Any information which you choose to share through participation in message boards, forums and/or chat rooms (including Protected Health Information ("PHI") and Personally Identifiable Information ("PII")), is by design open to the public as these are public services not a private, secure service. Careful consideration should be used before disclosing any PHI or PII in any public forum. What you have written may be seen, disclosed to or collected by third parties and may be used by others.

SOURCES OF PERSONAL INFORMATION

We collect personal information from the following sources:

·        Directly from you. We collect personal information that you provide directly to us when you place an order on the Site, create an account, sign up for our email or SMS marketing programs, submit a product review, use our Contact Us form, respond to a pop-up offer, participate in the Insole Advisor, or use a Custom Fit Orthotics Kiosk.

·        From third-party platforms and service providers. We may receive personal information from our e-commerce platform and related applications, including our marketing providers, web hosting providers, retail providers, and distribution providers.

·        Automatically through cookies, pixels, and similar technologies. In addition to the personal information you provide directly to us, we also collect information from you automatically as you use the Site via cookies, pixels, web beacons, and similar tracking technologies. 

We use essential, performance, marketing, and analytics cookies to collect your usage, device, and location information when you interact with the Site. We use this information to: (i) track you within the Site; (ii) enhance user experience; (iii) conduct analytics to improve the Site; (iv) prevent fraudulent use of the Site; (v) diagnose and repair Site errors, and, in cases of abuse, track and mitigate the abuse; and (vi) market to you more effectively across different web pages and social media platforms based on your browsing habits and history. 

 Third party marketing and analytics cookies (i.e. the ones we use for targeted advertising) may be considered a sale under state data privacy laws. To opt out of this sale of your personal information via cookies and the processing of your personal information for purposes of targeted advertising, please click here.  In general, you can also disable cookies by setting your browser to refuse cookies or indicate when a cookie is being sent. Please note, if you opt out of these targeted advertising cookies, your opt-out will be specific to the web browser, app, or device from which you accessed the opt-out. If you use multiple devices or web browsers, you will need to opt out of each browser or device that you use.

Third-party cookies to note on our Website include the following: 

o   Google Analytics. We use Google Analytics to collect information on your use of the Website for its improvement. To collect this information, Google Analytics installs cookies on your browser or reads cookies that are already there. Google Analytics also receives information about you from applications you have downloaded that partner with Google. We do not combine the information collected through the use of Google Analytics with personal information. Google’s ability to use and share information collected by Google Analytics about your visits to our Website or to another application which partners with Google is restricted by the Google Analytics Terms of Use and Privacy Policy. To prevent your data from being used by Google Analytics, you can download the Google Analytics opt-out browser add-on, which can be accessed hereYou can also follow the instructions in the “Your Information Choices” section.

o   Meta Pixel. We use Meta Pixel to customize our advertising and to serve you ads on your social media based on your browsing behavior. This allows your behavior to be tracked after you have been redirected to our Site by clicking on the Meta ad. Meta Pixel stores a cookie on your device to enable us to measure the effectiveness of Facebook ads for statistical and market research purposes. We do not have access to the information collected through Meta Pixel. However, the information collected via the Meta Pixel is also stored and processed by Meta. Meta may link this information to your various Meta  accounts and also use it for its own promotional purposes in accordance with Meta’s Data Usage Policy. Meta Pixel also allows Meta and its partners to show you advertisements on and outside of Meta. You can opt out of displaying Meta ads and sharing by visiting your Meta Ad Settings, and you can clear and control the information that third parties share with Meta in your Off-Facebook Activity page. If you do not have a Meta account, you can opt out of Meta ads through the Digital Advertising Alliance

HOW WE USE YOUR PERSONAL INFORMATION

We use the personal information we collect for the following business and commercial purposes:

·        Order Fulfillment. We use your name, postal address, phone number, and order information to process, ship, and fulfill orders placed on the Site. We share this information with our third-party logistics partner for this purpose.

·        Email and SMS Marketing. We use your name, email address, and phone number to add you to our email and SMS marketing programs if you have opted in, and to send you promotional communications, newsletters, and product updates.

·        Advertising and Audience Development. We use personal information, including email addresses, phone numbers, and names of individuals who have opted in, along with pixel-based browsing data, for the following advertising purposes: (a) performance optimization, where anonymized pixel data helps our advertising vendors' artificial intelligence identify individuals likely to perform a desired advertising action; (b) customer acquisition, where tracked action and event signals are used to match and identify audiences with similar preferences for marketing to new customers; and (c) remarketing, where CRM lists and site visitor data are used to re-target users and deliver relevant messaging.

·        Analytics and Site Improvement. We use non-identifiable browsing data, aggregated and anonymized, to determine popular content on our Site, measure the effectiveness of marketing programs, conduct A/B testing to improve user experience, and identify future improvements to our services.

·        Product Reviews. We use your name and contact information to compile and display product reviews you submit through our review system. You may choose a display name in lieu of your actual name. Reviews are shared only with your permission.

·        Custom Fit Kiosk and Insole Advisor. We use your name, email address, lifestyle preferences, and shoe size to help identify the right custom-fit orthotics insole for you. Providing personally identifiable information in the Insole Advisor is optional and is used only to save your results.

·        Affiliate Programs. We use your order details and related information to track conversions and route appropriate commissions to our affiliate partners, and to allow consumers to receive rebates or cash-back from affiliate partner loyalty programs.

·        Geolocation Services. We use your IP address and geolocation data to provide you with information about the nearest Custom Fit Orthotics Kiosk and nearby retail locations where our products can be purchased.

HOW WE SHARE YOUR PERSONAL INFORMATION

We may share personal information in the following instances:

·        Disclosure for a Business Purpose. We disclose the following categories of personal information to our service providers for business purposes such as customer relationship management providers, logistics providers, e-Commerce platform, product review providers, distribution providers, and advertising and analytics providers. 

·        In the event of a corporate reorganization. In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We will also share personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.

·        With Third Parties. We may need to disclose your personal information to third parties, such as legal advisors, law enforcement agencies, or governmental/regulatory bodies to protect our legal interests and other rights, protect against fraud or other illegal activities, prevent harm, for risk management purposes, and comply with our legal obligations.

·        For legal purposes. We share your personal information where we are legally required to do so, such as in response to court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights, as required to enforce our terms of service or other contracts; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law.

·        Sale of Personal Information. Scholl’s uses certain analytics and advertising cookies on its Sites. These cookies collect information about your internet or other electronic network activity and share it with the analytics and advertising partners that provide them. In some states, the use of third-party cookies for targeted advertising purposes may be considered a “sale” of personal information under applicable privacy laws. Scholl’s also shares personal identifiers and account information with advertising and marketing partners to support lookalike and targeted advertising. This type of sharing may be considered a “sale” under certain state privacy laws.  YOUR INFORMATION CHOICES

You have the following choices with respect to your personal information:

·        Correct or View Your Information. You may access your account to correct or view certain personal information you have provided to us and which is associated with your account.

·        Opt Out of Google Analytics. To prevent your data from being used by Google Analytics, you can download the Google Analytics opt-out browser, which can be accessed here.

·        Opt Out of Advertising Cookies. All session cookies are temporary and expire after you close your web browser. Persistent cookies can be removed by following your web browser’s directions. ·        Opt Out of Marketing Communications. You may opt out of receiving marketing emails from us by clicking the “unsubscribe” link provided at the bottom of each email we send. Please note that we will continue to send you notifications necessary to the Services.

 

·        Opt Out of SMS Messages. You may opt out of receiving marketing SMS Messages from us by responding ‘STOP’ upon receiving a SMS message. Please note, we may still continue to send you notifications necessary to the Services

U.S. STATE PRIVACY RIGHTS

Certain U.S. states, including California, Virginia, Colorado, Connecticut, Texas, and Utah, have enacted privacy laws that provide their residents with specific rights regarding their personal information. These rights may include the ability to access, correct, or delete personal information, as well as the right to opt out of certain uses of personal information, such as targeted advertising, the sale of personal information, or profiling in furtherance of decisions that produce legal or similarly significant effects.

Pursuant to Nevada Revised Statutes Sections 603A.300-360 we are required to disclose to Nevada residents’ information related to the sale of personal information. We do not sell customer information as covered by the above statute. A Nevada resident may submit a request for his/her information not to be sold by submitting a request to drscholls.care@drscholls.com.

NOTICE TO INTERNATIONAL USERS

Scholls processes PII on servers located in the United States ("US"). If you are a non-US user of the Sites, know that utilizing features of the Sites and providing Scholls with personal data, you acknowledge and agree that your personal data may be processed for the purposes identified in this Privacy Policy. In addition, your personal data may be processed in the country in which it was collected and in other countries, including the US, where laws regarding processing of personal data may be less stringent than or otherwise differ from the laws of the country in which you reside or are located when using our services. By providing your personal data, you consent to such transfers.

CHILDREN’S PRIVACY

The Sites provided by Scholls are not directed at children under the age of 13. If we learn that we have collected or received personal information from individuals under the age of 13, we will delete the personal information. LINKS TO OTHER WEBSITES

The Sites provided by Scholls may include links to other websites. The inclusion of a link on the Sites does not imply endorsement of the linked site, service or product. When following one of these links, once you leave the Sites, you are subject to the privacy policy of the new website.

 INFORMATION SECURITY

We implement and maintain reasonable security measures, such as access controls and encryption, to protect the personal information that we collect and maintain from unauthorized access, destruction, use, modification, or disclosure. However, no security measure or modality of data transmission is 100% secure, and we are unable to guarantee the absolute security of the personal information we have collected from you.

 DO NOT TRACK

We do not respond to Do Not Track requests. Do Not Track is a preference you can set in your web browser to inform websites and mobile applications that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

DATA RETENTION

We retain personal data for as long as necessary consistent with the purposes of use and in a manner consistent with our records management policies or as otherwise required by law (e.g., in connection with pending litigation).
